TRADE ALERT: CBP Publishes 10+2 “Interim Final Rule”

The Department of Homeland Security, Customs and Border Protection published the Importer Security Filing “Interim Final Rule” in the Federal Register published November 25, 2008. The effective date of this “Interim Final Rule” is
January 26, 2009. Enforcement will be delayed for 12 months (January 26, 2010) "so long as importers are making satisfactory progress toward compliance and are making a good faith effort to comply." Additionally, this "Interim Final" rule allows for a "structured review" that includes a comment period on 6 data elements
for which CBP is providing some type of flexibility (Container stuffing location, Consolidator (stuffer), Manufacturer (or supplier), Ship to party, Country of origin, and Commodity HTSUS number). These comments are due by June 1, 2009.
Although the basic requirements outlined in the January 2, 2008 Notice of Proposed Rulemaking (NPRM) remain unchanged, today’s notice contains several important changes and clarifications.

FLEXIBLE REPORTING: Among these are flexibility in reporting four data elements: Manufacturer (or supplier), Ship to party, Country of origin, and Commodity HTSUS number). CBP now will permit importers, in their initial filing, to provide
a range of acceptable responses based on facts available to the importer at the time, in lieu of a single specific response (which may become known to the importer only at a later time). Importers will be required to update their filings with
respect to these elements as soon as more precise or more accurate information is available, “in no event less than 24 hours prior to arrival at a U.S. port.” (Emphasis added) CBP also has added similar flexibility for the Container stuffing location and Consolidator (stuffer) elements by requiring submission “as early as possible”, and in any event “no later than 24 hours prior to arrival in a U.S. port.” (Emphasis added)

LOWER PENALTY AMOUNTS: The liquidated damages amount for violations of the Importer Security Filing requirements are changed from the value of the merchandise, as originally proposed, to $5,000 for each violation.

DATA ELEMENTS CLARIFIED: The party required to submit the Importer Security Filing is now defined as the “ISF Importer” and is construed as the owner, purchaser, consignee, or agent such as a licensed customs broker. The agent must have a power of attorney in English and retain that Power of Attorney for five years, although no particular format is mandated. The “Manufacturer (or supplier)” is defined to mean the “party supplying” the finished goods in the country from which the goods are leaving and that this party does not necessarily need to be the actual manufacturer (except where specifically required by current entry procedures (e.g. Apparel)). The manufacturer can be construed to refer to the invoicing party or parties, as permitted under existing Entry and Entry Summary procedures.

There is much more contained in the 57-page Federal Register Notice. Denise Simeonov

In these busy and turbulent times it is easy to forget what is important. Tomorrow
(25th November) is the second anniversary of the death of our dear friend and colleague Denise Simeonov. For those that knew her, I am sure you can still see her smiling face that brightened the room whenever she walked in. Our thoughts are with her family and friends.

Client Loyalty

I have recently discused in the blog that I am particpating in a project about client loyalty. This is project that has been developing throughout 2008 and has been driven by our Jim Ritchie our CEO.

One of the many benefits are that it brings teams together from all over the world to discuss and plan how we can continually improve the way we bring value to our clients. This of course is a very broad subject and has many subsections, but I guess in simple terms it is about doing more than anyone else would.

The thing I really like about this project is that it does not have a finish line, for example, my section are working on how we empower, engage and enthuse our staff. What could seem small areas like employing and training staff to passionately believe that we do not just move boxes rather we are responsible for our clients livelihoods, their well being and ultimately their happiness are not small they are massive.

Anyway I was taking a nostalgic look at an old IFW in which YRCL UK, formed as Ultimex 15 years ago, was recognised in the Sunday Times Fast Track 100 as the 41st fastest growing company in the UK. The article described the core values of Ultimex, and in short it could have been talking about the YRCL client loyalty initiative.

The only difference I could see was that as YRC Worldwide we have 66,000 employees & 1,000 locations worldwide, were as Ultimex we had 3 locations and 30 staff. Actually the other difference is some of the pictures in the article from a past era, very frightening how quickly time moves on.

Bringing Home Heroes

I regularly talk about that fact we do not move boxes we manage our clients livelihoods. Today I received an internal message from a client we support by managing movement of aircraft parts.

Quote from the client "See what the wonderful airplane that you support so superbly accomplishes - the RAF performs very similar missions!! THANK YOU for helping us bring home heros!!!"

If you get a chance, take a moment to view the information on the below link. You will see a great video of a C17 mission to extract wounded soldiers from Afghanistan. It made me realise that sometimes we actually really affect lives not just livelihoods.

Christmas Party

Even though my kids are now young adults, my wife still starts preparing for Christmas months in advance. It feels like a clear strategy to spend months finding ways to reduce my bank account by as much as possible every year. That saying I guess for putting up with me for 12 months I get away lightly.

YRCL UK have a National Christmas staff party planned for December, but with a difference this year. The difference is we are taking advantage that while we have many of our staff together we are including a company meeting in the afternoon. During this meeting we will be recognising our people in 5 categories, trainee of the year, operations employee of the year, support services employee of the year, exceptional employee of the year and member of staff excelling in our core values. I hope this will add an extra positive dimension to the festive party.

China Update

A focus post my last trip to China has been to ensure YRCL Europe staff are able to clearly talk to clients about the logistics capabilities of our organisation in China. The pleasing results are that our origin services are adding extra value to our clients which is brilliant. Our China Business Development team are able to provide more information on these service if required. The bonus for me is the more I build these services the quicker I get invited back to China again.
